Furthermore, Backup My Info! will not be liable for incidental or consequential damages even if it is advised of the possibility thereof. This limitation of Backup My Info! liability will apply regardless of the form of action, whether in contract or tort (including negligence).

Customer warrants that it is the owner or legal custodian of the data transmitted to Backup My Info! and that it has full authority to transmit said data and direct its restored data at its designated computer.
